1. Scope
These Terms of Service ("Terms") govern your use of the FTS Case Knowledge Platform ("Platform") operated by Ferrufino Tech Solutions ("we", "us"). By creating an account or using the Platform, you agree to these Terms. The Platform is offered to business customers (B2B) only; consumers within the meaning of § 13 German Civil Code (BGB) are not eligible.
2. Description of Service
The Platform provides tools for technical operations teams to capture, search, and verify incident and fault cases. Features include structured case cards, evidence management, AI-assisted drafting, full-text search, and a verification workflow.
3. Account Registration
You must provide accurate information when creating an account. You are responsible for maintaining the security of your credentials. One person or legal entity may hold only one account.
4. Subscription & Payment
Pricing tiers:
- Starter: €149 per month (up to 10 users, 1 workspace).
- Team: €499 per month (up to 50 users, 5 workspaces).
- Enterprise: on request (unlimited users, SSO, SLA).
All prices are net amounts; applicable VAT will be added. We may offer reduced pilot pricing for a limited period; after the promotional period ends, standard pricing applies. Billing occurs monthly in advance via Stripe (credit card or SEPA direct debit). You may cancel at any time; access continues until the end of the billing period. We reserve the right to adjust prices with 30 days' written notice.
5. Your Data
You retain all ownership rights to the content you upload ("Customer Data"). We process Customer Data only to provide and improve the Platform as described in our Privacy Policy.
You are responsible for ensuring you have the right to upload any data to the Platform and that it does not infringe third-party rights.
6. Acceptable Use
You agree not to:
- Use the Platform for illegal purposes
- Upload malicious content or attempt to breach security
- Reverse-engineer or scrape the Platform
- Share account credentials with unauthorized persons
- Exceed your plan's usage limits through technical means
7. Availability & Support
We target monthly availability of 99.5 %. Planned maintenance will be announced at least 48 hours in advance. Support is available at support@ferrufino-tech-solutions.com.
We are not liable for downtime caused by force majeure, third-party outages, or scheduled maintenance windows.
8. Liability
To the maximum extent permitted by law, our total liability is limited to the fees paid by you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or data loss caused by your fault.
Mandatory statutory liability (intent, gross negligence, injury to life, body or health) remains unaffected.
9. Termination
Either party may terminate the subscription with 14 days' notice to the end of any billing month (via support@ferrufino-tech-solutions.com). Upon termination, your data remains accessible in read-only mode for 90 days. After that, it is permanently deleted unless legal retention requirements apply.
We may terminate the agreement with 30 days' notice in case of payment default, material breach of these Terms, or significant security violations by you.
10. Changes to Terms
We may modify these Terms with at least 4 weeks' notice via email. If you object within that period, the subscription terminates on the effective date.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction for all disputes is Munich, Germany, provided the customer is a merchant or a legal entity under public law.
12. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
